针对专利维持时间评价指标在表征专利质量时无视不同领域技术更新换代周期不同的缺陷,以专利制度作用机理为理论指导,在综述众多研究成果的基础上,对专利维持时间进行无量纲化,提出一种可代替专利维持时间评价专利质量的新指标——专利优势度,并从领域专利优势度和整体专利优势度2个维度对专利质量进行论述和实证。结果表明,该指标克服了原有指标无视技术领域影响的缺陷,有效解决了专利质量跨领域比较的难题,对改进专利评价具有积极意义。
When using patent survival evaluation index to represent patent quality, the index would ignore the updating circle difference among various technology area. Aiming at this defect, this paper summarizes broad research achievement, uses patent mechanism as theory guide, normalizes the patent survival time, and finally proposes a new patent quality index: patent dominance, which could replace the patent survival one. Besides, the paper discusses and proves the new evaluation index in both sector and overall dimension. The result shows, the new index overcomes the original evaluation indiscrimination in various technology area, effectively solves the problem of patent quality cooperation in different areas, and could improve the patent evaluation effect.
